Tropical Paradise (TP) Boat Charter Terms and Conditions
1. General Information
- Service Offered: TP provides boat tours around Mahe and nearby areas.
- Vessel: Tours are operated on the Tropical Breeze boat. TP may transfer bookings to an alternative boat if necessary.
- Booking: By booking with TP, you accept these terms and conditions. Minimum rental duration is 2 hours. The rental includes always a skipper.
- Reservations: Bookings are for private trips and the whole boat is reserved. The boat can transport up to 4 passengers plus the crew.
- Facilities: The Tropical Breeze boat does not have a toilet. The vessel is not wheelchair-accessible.
- Place of departure/return: The departure of the boat is from Eden Island in front of the Border Walk restaurant. Different place of departure/return can be from the Marina in Providence if agreed in advance.
- Time of departure/return: Departure and return times are agreed upon with customers. Usual time for departure is 10:30 am with return at 04:30 pm. Passengers must arrive at the boat at the agreed departure time. Late arrivals will result in a shortened trip.
- Transport to and from the departure/return place: Land transport is not included in the trip price. TP can help in arranging a taxi on demand of passengers and TP will remain in all cases not responsible for the taxi service. Passengers will pay for their land transport directly to the taxi driver.
- Boarding: Passengers board by stepping off the quay. The skipper has the authority to alter routes or cancel trips due to weather
2. Safety and Conduct
- Mobile Phone: At least one passenger must have a functioning mobile phone with the provided contact number.
- Behaviour: The skipper may terminate the trip if passengers misbehave or are under the influence of alcohol or drugs. Alcohol is prohibited on board. Soft drinks and water are allowed on board and also provided by TP included in the price of the trip.
- Safety: The skipper is in charge of the boat’s safety. Passengers must follow skipper’s instructions promptly at all time. Access to the boat and jetties may be denied for reasons like safety, capacity, or public order.
3. Liability
- Passenger Property: TP is not liable for damage to or loss of passengers’ property. Passengers board at their own risk.
- Damage by Passengers: Passengers are liable for any damage they cause to TP’s property or third-party goods.
- Activities: All activities are undertaken at the passengers’ own risk.
- Children: Children under 5 are not allowed on board for safety reasons. Life jackets for children can be provided on request. Children between 5 and 10 years travel free but remain under the responsibility of an accompanying adult.
4. General Liability
- TP’s Liability: TP is not liable for personal injury or damage of any nature except for deliberate acts or gross negligence. Liability is limited to the rental price of the trip.
- Force Majeure: TP is not liable for inability to fulfil obligations due to unforeseeable circumstances beyond its control (force majeure).
5. Payment, Cancellation, and Amendments
- Payment: Boat excursion rates are set out in TP’s website. Rates for any other boat excursions not stated in the website are on request basis. Rates are quoted net in Euros and are valid for all year 2024. Should clients be paying in alternative currencies, the daily exchange rate is applied to the client at the time of payment. Applicable entrance &/or landing fees are included in TP’s excursion offerings, if otherwise not stated. Hotel transfers are not included in TP’s offerings.
- Confirmation: After providing a deposit of 20% of the tour cost, the booking is confirmed and TP will send a confirmation via email, SMS, or WhatsApp.
- Cancellation Conditions:
- Cancellation received up to 3 days before departure: full deposit will be returned and no charges incurred.
- Cancellation received less than 3 days before departure and no shows: full deposit will be forfeited and no other charges incurred.
- Weather conditions:All excursions are subject to weather conditions: in case of severe bad weather, it will be responsibility of the skipper to decide the cancellation or interruption of a tour. In case of cancellation, the excursion will be rescheduled or a total refund will be provided. In case of interruption the customer will be charged only for the time spent on the boat.
6. Final Provisions
- Prohibited Items: No shoes are allowed on the Tropical Breeze boat. Passengers must respect the environment and take all personal belongings and waste with them.
- Errors: TP is not bound by obvious errors in information. Terms are governed by Seychelles consumer law. Disputes are subject to Seychelles courts.
7. Complaints
- Notification: Complaints should be notified to TP as soon as possible. If unresolved within a reasonable time frame, submit a written complaint within 14 days of the trip’s end, specifying the nature of the complaint.
